Judge says casino barge stays

In Mississippi,
Harrison County Circuit Judge Robert H. Walker has ruled
that the Mississippi Gaming Commission over stepped their
boundries when it approved Treasure Bay's plans to move its
floating casino barge to a man made basin outside of state
waters.
By ruling in such a manner, a
permit allowing the new location for the barge to be a legal
gaming site has most certainly been voided.
Originally, Treasure Bay
Casino was tired of sustaining millions of dollars of damage
(a reported $39 million), that have been brought on by high
wind sustaining storms and hurricanes over the last ten
years. They set out to create a safer, more protected spot
for the floating casino barge to be placed.
By building a man made basin
on land owned by Treasure Bay Casino, it is said that they
would no longer have to lease the property like they
currently do from the Mladinich Family Limited Partnership.
It is also noted that Jake Mladinich, along with his family
were against the decision made by the Mississippi Gaming
Commission. They appealed it.
Judge Walker stated that
because the proposed gambling site was not in state waters,
only the Legislature would be able to rule on and decide a
casino to relocate outside of state waters. |
