| GamblingPhD menu | Hows That? January 13, 2009 So all of the hoopla surrounding the domain name ruling over in Kentucky is really over nothing? Seems that this might actually be true. When the Kentucky Court of Appeals Court rules as to whether or not the domain names can be seized, many will either breathe a sigh of relief or they will be hopping mad. But according to experts, it doesnt really matter one way or the other. After all, how are you going to exercise your new rights? According to legal experts there really isnt any way that the state will be able to legally enforce the seizures of the online gambling domain names. They say that as a legal matter it is not enforceable at all. However, they say that if the domain name registrars are willing to comply then they can enforce it otherwise it is simply a ruling on a piece of paper. Governor Steve Beshear may have initially won his case and gotten the online gambling domain names, but without the back up of the online gambling world and the domain name people, the ruling isnt worth the price of the piece of paper it is written on. The online gambling sites may choose to comply to get rid of the legal battle that would ensue but they dont have to. They may choose to follow along just until online gambling is legalized, which it is expected to do with Obama in office. However, they say the problem is what if another state decides they dont want health care sites in their state, are they going to be able to seize them as well? |
