| GamblingPhD menu | iMEGA Case May Be Heard in April January 27, 2009 The challenge was simple, the Interactive Media Entertainment & Gaming Association, or iMEGA, was taking on the United States government and the new Unlawful Internet Gambling Enforcement Act, or UIGEA. They stepped forward and challenged the law, which has gone through several steps up to this point. Now they have announced that their legal team has been asked by the US 3rd Circuit Court of Appeals to set a date for oral arguments. They have been asked to give availability in April to discuss the online gambling case, and were provided a list of dates. The US Department of Justice is the lead defendant in the suit, and they have been given a list of dates as well. The suit also names the Federal Trade Commission, or FTC, and the Federal Reserve as defendants. iMEGA is challenging the UIGEA saying that it is unconstitutional to prohibit banks from processing transactions between online gambling sites and the players within the United States. They argue that you cannot put the burden for handling this ban with the financial institutions, for they are incapable of handling it. They say that they are excited that the court is moving forward with the online gambling case and that they are going to be able to give oral arguments very shortly. They say that there are so many flaws in the online gambling act that they will have a hard time defending it in court.
