UIGEA Challenged

July 10, 2009

The US Department of Justice is currently working with the Federal Trade Commission and the Federal Reserve to fend off a court case brought about by the Interactive Media and Gaming Association. The iMEGA is arguing that the Unlawful Internet Gambling Enforcement Act, or UIGEA, that was attached to the Safe Port Act of 2006 is both unlawful and unconstitutional.

iMEGA has long been known for their various court cases as they pertain to the UIGEA and online gambling, and this is their latest attempt to get the law overturned. According to their website this latest attempt at legalizing online gambling is being heard at the 3rd Circuit Court of Appeals. There are several judges presiding over the case, as well as the various heads of the above federal departments.

iMEGA Chairman Joe Brennan, Jr. says that he is sure that once the evidence is brought forward and the judges really read the law that they will see the various problems with it. Brennan says that they will see the law is “defective” and he believes that they will overturn it upon coming to this realization.

There are those in the online gambling world that hope he is right. Otherwise they know that they will simply be looking at another few months before anything moves forward on the bill. They are hopeful and pessimistic at the same time. They know that they have gotten their hopes up before only to see them shot down, but they think they have a real chance this time.
