How Does Sotomayor Feel About Online Gambling?

May 30, 2009

With so much talk of legalizing, regulating and taxing online gambling, it is no wonder that many in the online gambling industry are wondering where Supreme Court Nominee Sonia Sotomayor stands on the subject. There are those that wonder about many other issues as they pertain to the nominee, but the online gambling industry is thinking that perhaps she is not who they want to see take over.

Sotomayor does not have a long history of supporting online gambling; rather she has been more in favor of the other side instead. She presided over a case crucial to the NFL and ruled with them and they are one of the largest supporters of the anti online gambling movement.

She has a history of sticking up for intangible assets as well, which puts her in the position of being able to keep online gambling sports sites from using game results. This would put the online gambling sites at a huge disadvantage. But on the other hand, she also shows that she has a sense of pragmatism in her decisions which could help online gambling get legalized. She sees the danger in allowing too much governmental control which is exactly what is going on right now.

Experts say that she has not come out officially one way or the other as it regards to online gambling, so they are not sure if she is for or against, or if she is possibly neutral. They say that other than having a judge that is gung ho about online gambling, the best they could hope for is neutral. They say that they would be happy with someone who looked at each instance in a case by case basis and considers all of the aspects of online gambling before ruling anything out.
